TERMS AND CONDITIONS
Under the
provisions of Civil Code Section 3072: All vehicles and their
contents will be sold "AS IS" today and all sales are
final.
Bill & Wags
Towing may state the year and model of the vehicles, however, it is
the responsibility of the buyer to ascertain by his own
means
the correctness of the vehicle's year and model prior to bidding.
The buyer
must register the vehicle with the Department of Motor Vehicles
within 10 days after purchasing it. The buyer assumes
full
responsibility for transfer of ownership through the Department of
Motor Vehicles.
A $200.00
non-refundable deposit must be paid after each vehicle.is sold. The
balance must be paid no later than 1 PM on the sale
day.
All sales are CASH ONLY. No checks or credit cards will be accepted.
These
vehicles have been appraised at $4000.00 or less. Should the bid on
these vehicles exceed $4,200.00, said vehicles will be
taken
out of the sale and reliened through the Department of Motor
Vehicles to be sold at a later date under Civil Code Section
3071.
Should a vehicle sell for over $4,000.00 but not over
$4,200.00 the buyer will be given the lien sale documents as well as
a statement
of
facts.
Prior to
registering the vehicle with D.M.V., do not drive or park the
vehicle on a public street. Some of these vehicles are impounded
for
excessive parking violations and expired registration. They can be
impounded again if the D.M.V. records still show the
expired
registration
or unpaid citations.
Buyer is
responsible for all D.M.V. fees, penalties and past due
registrations; however, the buyer is not responsible for
any
outstanding
parking citations.
Bill & Wags Towing reserves the
right to accept bids in any increment they feel is in the best
interest of the sale. Bidding is done in
minimum increments of
$25.00 and maximum increments of $100.00. All opening bids are taken
from the floor.
Bill & Wags
Towing and its representatives do not accept responsibility for
failure of any equipment sold or failure to meet the
safety
standards
on classifications of equipment sold by the Department of Labor,
Safety, and Health Regulations, CAL OSHA, Federal OSHA,
or
the Environmental Protection Agencies. It is the express
responsibilty of the buyer to determine what safety equipment must
be in
services on any machinery purchased and to comply with
those regulatory requirements prior to using any vehicles purchased.

Towing and its representatives do not in any way guarantee the
odometer reading to be actual, true or correct. All vehicles
sold
through sale are sold "TRUE MILEAGE UNKNOWN".
Bill & Wags
Towing reserves the right to bid on any vehicle. Any representative
or employee of Bill & Wags Towing bidding on vehicles
will
be introduced prior to the sale commencing.
If you are
going to bid, be sure you have registered. Do not bid with someone
else's number, if you do, your bid will be canceled.
Each vehicle
has a sale number, which corresponds to the number on you sale list.
Before the company representative sells off each
vehicle he will
call out the vehicle's number and a description of that vehicle.
Please make sure you bid on the correct vehicle. If you
don't
and you are the highest bidder, you still must purchase that
vehicle. If you do not purchase that vehicle then you will be asked
to
LEAVE
THE SALE!
In case of
incorrect paperwork Bill & Wags Towing will not be liable for repairs
made to any vehicle before the DMV registration
process
has been completed. Only the purchase price and parking tax will be
refunded.
Vehicles
are to be removed from the lot immediately after the sale has been
completed. However, before the vehicle is removed,
the
buyer must come to the office and sign the paperwork to finalize the
sale and transfer of title. All documents will be issued and
called
by
bidder number. Any vehicles not removed from the lot by 3:00 p.m. of
the sale day will be charged storage fees based upon the set
rate
of $30.00 per day after the first 3 hours.
There is absolutely no working on vehicles in the yard. Only one person per vehicle will be allowed in the yard. No exceptions!
All smog-related repairs are the sole responsibility of the buyer.
Any person who removes parts or property from a vehicle on sale prior to the sale will be asked to leave the premises.
Replacement of parts and any
repairs made to a vehicle purchased a lien sale before said vehicle
is registered in your name will
not be honored by Bill & Wags Towing
in the event of and invalid lien.
The license plates will be removed from all vehicles that are sold under C.V.C. 3071 & 3072. TERMS OF SALE FOR VEHICLES APPRAISED OVER $4,000.00 PER CIVIL CODE SECTION 3071
Although you must pay a deposit of $1,000.00 at the time of purchase, there is a 10-day redemption period in which the vehicle must remain at Bill & Wags Towing. During these 10 days, the legal or registered owner may redeem the vehicle for the amount of the towing, storage and lien charges. If the vehicle is redeemed, the deposit paid plus 12% per annum will be refunded back to the buyer. If the legal or registered owner does not redeem the vehicle within 10 days, then all D.M.V. lien sale documents will be completed and delivered to the buyer at 10:00 AM on the 10th day following the date of sale.
